Terms & Conditions

Introduction

These are the terms and conditions upon which each Entry to the BIMA Awards shall be subject. If the British Interactive Media Association (“we,” “us,” “our,” or “BIMA”) accept an entrant’s (“you,” “your,” “yourself” or “entrant”) Entry, you will be bound by these terms and conditions and your Entry shall be considered and judged in accordance with these terms. We reserve the right to amend these terms and conditions at any time and such changes shall be deemed notified to you by their publication on the Website.

Definitions

1. The following terms shall have the following meaning in these terms and conditions:

‘BIMA Awards’ means the media competition known as the BIMA Awards whereby Interactive Multimedia is judged by BIMA and awards are given in relation to the Categories.

‘Category’ means each particular category of award to be granted and presented by BIMA in the course of the BIMA Awards as more particularly listed and detailed on the Website.

‘Closing Date’ 31st July 2008.

'Interactive Multimedia' means software programs which enable the user or viewer to influence the course and/or content of the software, and which contain a significant number of at least any two of the following: (a) still or moving pictures, (b) sound or music, (c) animation or graphics.

‘Delivery Platforms’ means such platforms for storage of Interactive Media which are acceptable to BIMA including, for published and commissioned titles, optimal disc formats including, CD-Rom and DVD, and magnetic discs including removable hard drives and purpose-built Kiosks, applications delivered on the World Wide Web or proprietary networks, and for mobile projects any portable digital device.

‘Entry’ means your entry for your Interactive Media to be considered for entry in the BIMA Awards.

‘Fee’ means the relevant entry fee corresponding to the relevant Entry according to the relevant Category for which the Entry is made as set out on the Website.

‘Judging Criteria’ means the criteria and bases for judging Entries and granting awards to Entrants in the course of the BIMA Awards.

‘Kiosk’ means a special purpose computer designed for public access located in a public space providing access to and delivering Interactive Media.

‘Website’ means the BIMA website accessible at www.bima.co.uk.

BIMA Awards Entry Formalities

2. In order to validly enter the BIMA Awards, each Entrant must be over the age of 18. All Entries must be submitted in the English language via the online entry form on the Website, and the Entry must be accompanied by all relevant software if applicable, and appropriate Fee (accept for free entries) submitted in accordance with these terms. Each Entry must relate to specific Interactive Multimedia identified in the relevant Entry and must be submitted to BIMA in accordance with these terms and conditions and by submitting an Entry you confirm that you accept these terms and conditions and you have the agreement of all parties associated with the project that the submission be made.

3. Each Entry must be completed in full and received by BIMA on or before the Closing Date together with the Fee. Entries received after the Closing Date will be disqualified and will not be considered by BIMA and the entry Fee will be forfeited. Entries which are not fully functional will be disqualified by BIMA at its sole discretion and any entry Fee shall be forfeited.

4. In the event that an Entry is inaccurate or incomplete, does not comply with these conditions for entry or is deemed, at the sole discretion of BIMA, ineligible for any other reason, then the relevant Entry will be disqualified and the entry Fee will be forfeited. For the avoidance of doubt the entry Fee is non-refundable.

5. No Entry will go forward for judging by BIMA unless full payment of the Fee is received before judging commences, as notified on the Website.

6. The Entrant may provide a brief description of any software title or Internet site used for the relevant Interactive Media, together with its objectives, the target audience and information demonstrating its success. In the event that the Entrant wishes to submit such additional descriptive information, this should be included within the online entry form when submitting the Entry. Further information relating to an Entry shall not be admissible after the Entry is submitted via the online entry form.

7. In the event that any accompanying software exists in a format which is not transmissible online (e.g. on CD-Rom/DVD etc), the Entry must nevertheless be submitted via the online entry form noting that the formatted media is to follow and the software must be forwarded by post to the address of the BIMA office as set out on the Website with a print out of your online receipt.

8. In the event that any of the Interactive Multimedia relating to a relevant Entry is accessible via Kiosks or other installations, the location of where the Kiosks or other installations can be viewed must be entered on the online entry form submitted via the Website together with a note of a relevant contact person where necessary. Entries relating to Interactive Multimedia on Kiosks or other installations outside the United Kingdom will not be accepted and will be disqualified and the entry Fee forfeited, except at BIMA’s sole discretion where the relevant Interactive Media is submitted and accessible via an alternative format accessible in the United Kingdom. For the avoidance of doubt, BIMA judges shall not travel outside the United Kingdom in order to view any Interactive Media, Kiosk or other installation.

9. Neither Entries nor any accompanying Interactive Multimedia will be returned to you unless you make acceptable arrangements with the BIMA office prior to the judging of the relevant Entry. A return envelope with postage paid must be provided.

10. Entries which have been entered in a previous BIMA Awards competition and have not been significantly updated, are not eligible for this year's competition and will be disqualified from this competition.

11. You may submit any number of Entries to the BIMA Awards.

12. You may place your Entry in more than one Category.

13. You may make more than one Entry in any given Category.

Passwords

14. It is a requirement that any passwords needed to open programs or web sites be submitted to the BIMA office at the time the Entry is submitted. Any password must remain active and the entry remain viewable until at least 30th November 2008.

15. If the Judges find that they are unable to access any Entry because of failure to disclose the password when the Entry is submitted, the Entry may be disqualified and the entry Fee forfeited.

Judging Entries

16. BIMA shall consider each Entry through a judging panel as listed on the Website on its merits and on the basis solely of the information and Interactive Multimedia referred to in the relevant Entry and at its discretion all Entries shall be considered in accordance with these terms and conditions and the Judging Criteria.

17. Judging will take place in September 2007 or as otherwise decided by BIMA. In relation to Entries relating to Interactive Multimedia existing on Kiosks and other installations, relevant Entrants will be contacted to arrange a convenient time for viewing by the BIMA of the relevant Kiosk or other installation. Entrants in all other Categories are not required to be present for the judging.

18. BIMA will short list certain Entrants to go through to a final judging phase. Winners in the Categories will be announced by BIMA at the Awards presentation ceremony at the end of November 2007 and such winners will be selected by the Judges from the shortlist.

19. BIMA’s decisions relating to short-listing and granting of awards in the course of judging the BIMA Awards is final and BIMA will not enter into any correspondence or discussion with any Entrants on any subject nor will BIMA accept any submissions or representations or appeals with regard to such decisions, and BIMA reserves at its sole discretion the right to:

  • disqualify Entries which do not comply with these conditions or for any other reason;
  • not to make any particular award in any given Category; 
  • move an Entry to another Category without notice, if BIMA feels it would be better suited in the relevant Category;

Limitations and Disclaimer

20. BIMA will not be responsible or liable, financially or otherwise, in respect of any malfunction of any Interactive Multimedia or any other event related in any way to an Entry or the judging procedure.

21. BIMA accepts no responsibility, financial or otherwise, for: 

  • any promise or indication made public before an Award is formally announced; 
  • any damage whatsoever caused by any actions taken by BIMA in relation to any particular Entry including damage to any Interactive Multimedia submitted with Entries.

22. In no event shall BIMA be liable whether in contract, tort, by statute or otherwise in respect of any loss of profits and/or loss of business for any special, indirect, incidental or consequential loss or damage arising out of or in connection with the BIMA Awards, including without limitation: loss of revenue, loss of anticipated savings, loss of business and/or goods, loss of goodwill, loss of use, loss and/or corruption of data and/or other information, including as a result of loss or damage caused by or to Interactive Multimedia submitted with Entries.

23. Nothing in these terms and conditions shall exclude or restrict our liability for fraudulent misrepresentation and/or for death or personal injury to the extent that such injury results from our negligence or willful default.

24. For the avoidance of doubt, entrants agree and accept that they will be solely responsible and liable for any and all damage caused by their Entry or the Interactive Multimedia submitted to BIMA therewith.

Free Entries and Discounts

25. Full Commercial Members of BIMA shall be entitled to the following free and discounted Entries to the BIMA Awards: 

  • two free Entries, subject that such Entries are for two separate and distinct Interactive Multimedia projects; and 
  • the same project in a second Category will be charged at the full member's rate of £130 + VAT and any subsequent entries of the same project will be charged at £100 + VAT per Category.

26. Associate Commercial and Institutional Members of BIMA shall be entitled to the following free and discounted Entries to the BIMA Awards: 

  • one free Entry; and 
  • the same project in a second Category will be charged at the full member's rate of £130 + VAT and any subsequent entries of the same project will be charged at £100 + VAT per Category.

If Your Entry Has Been Short Listed

27. You will be informed whether your Entry has been shortlisted during September/October 2007 via a notification on the Website. Any changes to this timescale shall be posted on the Website from time to time.

28. You will be required to supply screenshots and other information to BIMA to be used for display during the BIMA 2007 Awards Night in November 2007. Entrants authorise BIMA to publicly display all and any such screenshots and information provided to BIMA for this purpose.

Governing Law

These terms and conditions shall be interpreted in accordance with and governed by English law.
